TERMS AND CONDITIONS OF UOB BIOMETRIC ACCESS SERVICES

  1. These terms and conditions ("Terms") apply to your use of UOB unique biometric identifier login services (“UOB Biometric Access Services”) provided by United Overseas Bank Limited ("UOB" or the "Bank" or “we”). If you do not accept these Terms, please stop accessing and using the UOB Biometric Access Services.

  2. These Terms supplement, are in addition to and are to be read together with the Terms and Conditions of UOB Personal Internet Banking and UOB Mobile Services.

  3. In the event of any conflict or inconsistency, these Terms shall prevail over the Terms and Conditions of UOB Personal Internet Banking and UOB Mobile Services in relation to any matter concerning the UOB Biometric Access Services to the extent of such conflict or inconsistency.

  4. UOB Biometric Access Services is a service provided by UOB where you may use your fingerprint, facial scan, or other unique biometric identifier as we may, in our sole discretion and from time to time, prescribe as an acceptable method of identification (“Unique Biometric Identifier”) stored/registered in the Mobile Device (as defined below) as an alternative to logging in to the UOB Mobile Services application (the "UOB App") with your username and password.

  5. UOB Biometric Access Services is part of the UOB mobile services, available for the following customers:
    1. customers using Apple iPhone 5s or newer phones or Apple iPad (5th generation, iPad Pro, iPad Air 2, iPad mini 3 or newer models, operating on Apple iOS 8 or newer systems, and registered with Apple Inc’s Touch ID ("Apple Devices")..; and
    2. customers using mobile devices (mobile phones or tablets) which operate on the Android 6.0 operating system or newer systems ("Android Devices"), and on which Unique Biometric Identifier recognition software is installed and/or enabled;

      (the Apple Devices and the Android Devices are hereinafter collectively referred to as the "Mobile Devices" and each a "Mobile Device").

  6. To use UOB Biometric Access Services, you will need to:
    1. be a customer of UOB and be a valid user of the UOB Personal Internet Banking and UOB Mobile Services;
    2. have installed the UOB App on your Mobile Device;
    3. register for UOB Biometric Access Services by completing the registration process by logging in to the UOB App with your UOB Personal Internet Banking or Mobile Banking username and password;
    4. have at least one Unique Biometric Identifier stored/registered in your Mobile Device; and
    5. agree to and comply with these Terms.

    Once your Mobile Device is successfully registered with the UOB Biometric Access Services, you may use any of the Unique Biometric Identifier that is stored/registered in your Mobile Device to access the UOB App on your Mobile Device(s) as an alternative to logging in to the UOB App with your username and password. You may still choose to access the UOB App using your UOB Personal Internet Banking or Mobile Banking username and password.

  7. By enabling the UOB Biometric Access Services on the UOB App, you understand the need to protect your Mobile Device and shall be responsible for all use of your Mobile Device (whether authorised by you or otherwise) to access UOB Mobile Services. Once your Mobile Device is successfully registered with the UOB Biometric Access Services, your account balance can be accessed with Unique Biometric Identifier recognition software registered in your Mobile Device. If persons other than yourself have their fingerprints registered as part of the Unique Biometric Identifier recognition software of your Mobile Device, such persons will be able to access your account as well.

  8. You agree that, you shall not allow any Unique Biometric Identifier belonging to anyone besides yourself from being registered in your Mobile Device and to allow such Unique Biometric Identifier to be used to access the UOB App. You also acknowledge that the Unique Biometric Identifier authentication is performed by the UOB App by interfacing with the Unique Biometric Identifier authentication module on your Mobile Device and that you agree to the authentication process.

  9. You can deactivate the UOB Biometric Access Services at any time using the left navigation menu of the UOB App.

  10. Each time the UOB App detects the use of a Unique Biometric Identifier stored/registered on a Mobile Device on which you have registered for the UOB Biometric Access Services to access UOB mobile services or authorise transactions, you are deemed to have accessed UOB mobile services and/or instructed UOB to perform such transactions as the case may be.

  11. You acknowledge and agree that, for the purposes of the UOB Biometric Access Services, the UOB App will be accessing the Unique Biometric Identifier stored/registered in your Mobile Device, and you hereby consent to UOB accessing and using such information for the provision of the UOB Biometric Access Services.

  12. You acknowledge and agree that we make no guarantee, representation, warranty or undertaking of any kind, whether express or implied, statutory or otherwise, relating to or arising from the use of UOB Biometric Access Services or the UOB App, including but not limited to:
    1. whether UOB Biometric Access Services or the UOB App will meet your requirements; or
    2. whether UOB Biometric Access Services or the UOB App will always be available, accessible or function with any network infrastructure, system or such other services as we may offer from time to time; or
    3. as to the security of the Unique Biometric Identifier function of any Mobile Device

  13. You cannot hold us liable for any loss you may suffer in connection with UOB Biometric Access Services howsoever arising (whether reasonably foreseeable or not), even if we have been advised of the possibility of the loss, including loss from:
    1. the provision by us of and/or your use of the UOB Biometric Access Services or the UOB App;
    2. any unauthorised access and/or use of your Mobile Device;
    3. the use in any manner and/or for any purpose by any person at any time of any information or data:
      1. relating to you;
      2. transmitted through your use of UOB Biometric Access Services or the UOB App; and/or
      3. obtained through your use of UOB Biometric Access Services or the UOB App;
    4. access to the UOB App by way of the UOB Biometric Access Services by anyone other than yourself;
    5. any event the occurrence of which we are not able to control or avoid by the use of reasonable diligence; and/or
    6. the suspension, termination or discontinuance of the UOB Biometric Access Services or the UOB App.

  14. You agree to indemnify us and keep us indemnified against any loss suffered by us in connection with:
    1. your access and use of the UOB Biometric Access Services and the UOB App;
    2. any improper or unauthorised use of UOB Biometric Access Services or the UOB App by you, or any improper use of your Mobile Device (whether authorised by you or otherwise);
    3. any act or omission by any third party (including a relevant mobile or internet service provider);
    4. any delay or failure in any transmission, despatch or communication facilities; or
    5. any breach by you of these Terms.

  15. To the extent that any of the limitations set out above are not permitted by law, our liability to you arising from or in respect of your use of UOB Biometric Access Services or the UOB App, whether in contract, tort (including negligence or breach of statutory duty) or otherwise for any and all losses, damages or liabilities caused or arising from or in relation to our provision of UOB Biometric Access Services or the UOB App shall not exceed the fees and charges received by UOB from you in respect of the your use of UOB Biometric Access Services and the UOB App.

  16. If any of these Terms is invalid, unlawful or unenforceable under the laws of any country, it shall not affect or impair the validity, legality or enforceability of the rest of these Terms and/or these Terms under the laws of any other country.

  17. Any failure or delay by us in exercising or enforcing any right we have under these Terms does not operate as a waiver of and does not prejudice or affect our right subsequently to act strictly in accordance with our rights.

  18. In the event we are unable to observe or perform any of these Terms due to or caused by events beyond our control or events which we cannot reasonably be expected to prevent or avoid, we shall be excused from performing these Terms for the duration of the disabling event. We shall not be liable for any delay, loss, damage or inconvenience caused or arising from or in connection with the disabling events. Examples of such events include but are not limited to equipment, system or transmission link malfunction or failure, fire, flood, explosion, acts of elements, acts of God, acts of terrorism, wars, accidents, epidemics, strikes, lockouts, power blackouts or failures, labour disputes or acts, demands or requirements of governments.

  19. Unless we expressly state so, a person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act (Chapter 53B) of Singapore to enforce or enjoy the benefit of any of these Terms.

  20. These Terms are governed by and interpreted according to the laws of Singapore. You agree to irrevocably submit to the exclusive jurisdiction of the courts of Singapore which means that legal proceedings against us can only be brought in the courts of Singapore.
